TERMS OF SERVICE AND USER AGREEMENT: Last Updated: 10/19/2021

By Submitting the provided commission request and commissioning SpookyCrewVT you are agreeing to the following as the Owner, End User, and Commission Requester:

Definitions:

Owner: The individual requesting the commission intended to be defined as the owner of the completed model, the end-user, and the individual who requested the commission and paid.

Creator: Specified as SpookyCrewVT, the creator of the character assets and content which will be provided to the Owner of the Model hereby referred to synonymous.

Commercial uses include streaming, video, or picture content creation using the commissioned model on a platform with the intent to profit from financially either for payment, tips, or donations; examples include but are not limited to Instagram, Twitter, Twitch, YouTube, BiliBili, NicoNicoDouga.

Personal uses are defined as offline use or online use for profile pictures, usage as an in-game avatar in VRChat (may not be uploaded to VRChat and made publicly available to copy or save by other parties and may only be used expressly by the Original Owner of the model), in Discord or Skype video calls or on other video messaging services.

Terms:

Personal use only unless specified. Additional prices will be charged for commercial use. No Refunds will be provided once the commission has begun.

Please include all the details and check your briefing carefully. SpookyCrewVT will not accept major changes requested to the model resulting from glitching, error, or damage that he was not liable for (i.e. system limitations, software updates or errors, Model changes done by end-user or other parties, or use as not intended by the Creator).

The finished work might appear on the SpookyCrewVT site or stream for advertisement. The end-user must specify if they wish to keep the model private for non-advertisement purposes.

The end-user holds the right to change or edit the finished models but may not claim themselves as the creator of the model and proper credits must be provided in any content created which includes the model as a copy and paste in the description as specified below:

Special Uses Clause:

As the end-user, you hold the rights of intellectual property and may use the model per the license agreement which includes where specified, the usage of the model for commercial or personal use (license specific to the license purchased and listed on the invoice), sexual or violent content at your discretion. SpookyCrewVT is not responsible for actions taken against or by the model or owner of the model and retains crediting rights solely for the creation of the model and its assets as provided with knowledge of the use for VTubing or V-Idol purposes and content creation. SpookyCrewVT will not charge additional royalties or surcharges at any later date but does accept free will donations or tips for previously completed work. SpookyCrewVT will not pursue additional fees or reimbursements once the initial agreed commission is paid in full and completed with issuance of the license which will include the date of completion unless the end-user is found to be using the Model outside of the agreed upon license (i.e. for Commercial purposes when model is licensed for personal use explicitly) and will only pursue the license upgrade fee at that time.
